By licensing CLEAR Alliance training services and/or educational products, the TMEC Instructor or Licensee agrees to the following: The Tobacco Marijuana & E-Cigarettes Course (TMEC) and its related TMEC Kit support materials, “Did you know?” educational media campaign ads, and educational flyers, are copyright protected and owned by CLEAR Alliance. ©Copyright. Other copyright protected, trademarked, or referenced material mentioned in CLEAR Alliance training and/or educational products are the property of their respective owners.
Posting, uploading, or linking any of the TMEC and/or any of the TMEC Kit’s support materials on the internet is strictly prohibited . “Did you know?” ads and educational flyers may be posted on the internet strictly for educational purposes and in their original format only (for example: posting for social media campaigns), as per the terms provided below. Any duplication, distribution, commercial exploitation of the content, modification, or additional use of the TMEC, its related TMEC Kit support materials including TMEC curriculum presentation, the “Did you know?” educational media campaign ads, and/or educational flyers, except as provided below, requires express written permission from CLEAR Alliance.
Attendees or student participants of TMEC are prohibited from filming or recording any of the TMEC curriculum presentation or accompanying training. The TMEC Instructor or Licensee agrees to prohibit any filming or recording of the TMEC curriculum presentation or accompanying training.
Each participant (whether student, Instructor, or other person) shall not share their registered access, curriculum kit files, or any other associated copyright materials with another person or entity.
No trademark license other than that implied by the use of the unmodified course materials as necessary for promoting and conducting the TMEC is express or implied.
All licenses granted pursuant to the terms of this agreement are non-transferable.
Exceptions:
TMEC Instructors or Licensees may hide slides necessary for class time constraints – or – slide(s) that contain news stories that may be considered too sensitive to a local community at that time, provided that the remaining slides retain any copyright notice originally included with the material. For Oregon: Adding or manipulating the content of the TMEC curriculum presentation without express written permission from CLEAR Alliance is strictly prohibited . Any requests from TMEC Instructors or Licensees to add or incorporate their local community data in a slide must be pre-approved by CLEAR Alliance. TMEC Instructors or Licensees must make this request in writing at least 3 weeks in advance to CLEAR Alliance and accompany verifiable documentation that the local data is from a credible source and is evidence based. CLEAR Alliance reserves the right to refuse any The approval by CLEAR Alliance does not make CLEAR Alliance responsible or in any way liable for any misinformation, incorrect data, or content provided in the modified slides or by any presenter, TMEC Instructor, or Licensee. For States and Territories (outside of Oregon): For states and territories outside of Oregon, ONLY specific and designated slides in the TMEC curriculum presentation are permitted for TMEC Instructors or Licensees outside of Oregon to add or incorporate their own local/state/territory’s evidence-based data and to reference credible sources . CLEAR Alliance is not responsible or liable in any way for any misinformation, incorrect data, or content provided in the modified slides by any presenter, TMEC Instructor or Licensee. Adding or manipulating ANY OTHER content or slides of the TMEC curriculum presentation without express written permission from CLEAR Alliance is strictly prohibited . Any requests from TMEC Instructors or Licensees to add or incorporate their local community data in a slide must be pre-approved by CLEAR Alliance in writing. The copied material must retain any copyright notice originally included with the material. Manipulating the content of any of the TMEC Kit support materials without express written permission from CLEAR Alliance is strictly prohibited . If CLEAR Alliance “Did you know?” ads are included with the TMEC kit or licensed individually online, the TMEC Instructor or Licensee is permitted to print, copy and digitally share each ad in its original PDF/PNG format strictly for educational purposes for which the TMEC program is intended. The printed, copied, and shared material must retain any copyright notice originally included with the material. Manipulating the ad’s content is strictly prohibited . If you have questions regarding appropriate locations to share the “Did you know?” ads, please contact our office. If CLEAR Alliance educational flyers are included with the TMEC kit or licensed online, the TMEC Instructor or Licensee is permitted to print, copy and digitally share each flyer in its original PDF/PNG format strictly for educational purposes for which the TMEC program is intended. The printed, copied, and shared material must retain any copyright notice originally included with the material. Manipulating the content of any flyer is strictly prohibited . Except as otherwise specified herein, copying or manipulating this curriculum or its accompanying support materials, in whole or in part, without CLEAR Alliance’s express written permission violates federal law and is expressly forbidden by CLEAR Alliance. I understand CLEAR Alliance’s educational programs and materials may be updated or subject to change at any time, and agree to utilize the most updated educational programs and materials available. I agree to act in the best interest of CLEAR Alliance at all times. I agree to teach with fidelity and as intended. I agree to not act in any manner directly or indirectly, which may damage the business operations of CLEAR Alliance. I agree to not adversely affect the goodwill reputation or business relations of CLEAR Alliance with its customers, the general public, its employees, contractors, or constituents.:*
